PolyFoam Antitrust Settlement, $100 Or More In Rebates

This is a lawsuit regarding upholstered furniture that contain flexible polyurethane, such as mattress toppers, pillows or carpet underlays.


The settlement is for the aforementioned products that were manufactured in the United States and purchased during the period beginning in January 1999 to March 1, 2019.

Only purchases (not for resale) made in the following states qualify for a rebate:

  • Colorado
  • Florida
  • Hawaii
  • Illinois
  • Iowa
  • Kansas
  • Maine
  • Massachusetts
  • Michigan
  • Minnesota
  • Mississippi
  • Missouri
  • Nebraska
  • Nevada
  • New Hampshire
  • New Mexico
  • New York
  • North Carolina
  • North Dakota
  • Oregon
  • Rhode Island
  • South Dakota
  • Tennessee
  • West Virginia
  • Wisconsin
  • District of Columbia

The plaintiffs allege that certain manufacturers of flexible polyurethane foam, which is used in upholstered furniture, carpet underlay (also called carpet padding or carpet cushion), and bedding (for example, mattresses, mattress toppers, or pillows) conspired to raise the prices of flexible polyurethane foam. Plaintiffs contend that Defendants’ actions violated numerous States’ antitrust and consumer protection laws.

The defendants deny the allegations however the court presiding has granted preliminary approval of the combined settlements.
